Minnesota custody is governed by Minnesota Statute 518.17. In Minnesota, unmarried father's need a court order giving them visitation and custody rights, otherwise, unmarried mothers have sole legal and sole physical custody and unmarried fathers have no rights, unless they file in court to obtain rights. Minnesota does not have a legal presumption in favor of joint physical custody, or against it. There is a presumption in favor of joint legal custody however, in the absence of domestic abuse. Minn. Statutes Sec. 518.552 governs Spousal Maintenance. Also known as Alimony, is part of the main divorce action. Defined in Minn. Stat. Sec. 518.58, Marital property is divided and allocated, as is marital debt, to the each party as part of the divorce action. Property includes pensions, real estate, bank accounts. Pensions are divided by separate orders called Qualified Domestic Relations Orders or QDRO and award one party their marital interest in both defined benefit pension plans and define contribution plans. Domestic abuse restraining order known as an Order for Protection under Minnesota Statutes 518B.01 is an action separate from a divorce which grants relief to provide protection to the victims of domestic abuse such as excluding the other party from the home, ordering no contact with the victim, and violation of such an order is reportable to law enforcement and subjects the violator to arrest, jail and a separate criminal charge for violation of the order.
